These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “customer”, “buyer”) and [Govind Narayan Art Gallery] (“we”, “us”, “our”, “the Company”), governing your access to and use of [www.govindnarayanartgallery.com] (the “Site”), including all content, product listings, custom-order services, and any IT services offered on it, and every order — domestic or international — placed through the Site. By accessing the Site, browsing our catalogue, registering an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in full, including our Privacy Policy, Cancellation, Return & Refund Policy, Shipping & Delivery Policy, and (for orders outside India) our International Shipping, Customs & Export Compliance Policy, each of which is incorporated by reference into these Terms and together form the entire agreement between you and us in respect of your use of the Site and any order. If you do not agree to any part of these Terms, please do not use the Site or place an order.
You must be at least 18 years of age, or be using the Site under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf, and be otherwise competent to enter into a binding contract under the Indian Contract Act, 1872 (or the equivalent contract-capacity law of your country of residence, if you are ordering from outside India). By placing an Order, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
We take reasonable care to ensure product descriptions, dimensions, weight, and material composition are accurate at the time of listing, in line with the Legal Metrology (Packaged Commodities) Rules, 2011 where applicable to packaged goods. As many items are handcrafted, dimensions and weight are approximate and subject to the natural tolerance inherent in handmade work (see also our Disclaimer). We reserve the right to correct any listing error at any time without liability, provided that where you have already placed a Confirmed Order based on an erroneous listing, Section 4 above governs.
For custom-commissioned statues, temples, or bespoke pieces, the specific design, dimensions, material, finish, and price will be confirmed with you in writing (email/WhatsApp/order note) before production begins. The typical process is: (a) you share your requirement; (b) we provide a quotation and, where relevant, a design reference or sketch; (c) you approve the specification and pay the agreed advance/token amount; (d) production begins; (e) where agreed, we may share progress photographs for your review before final finishing; (f) the piece is packed and dispatched per Section 4 and our Shipping & Delivery Policy. Because production only starts once your specifications and any required advance payment are confirmed, and because each piece is hand-produced specifically for you and cannot be resold to another customer, Custom Orders routinely take significantly longer than the 15-day minimum applicable to Ready-Stock Items — typically several weeks to a few months, depending on size, material, and complexity of the commission, and this extended timeline will be communicated to you at the time of order confirmation. Reasonable revisions to design details requested by you before production begins may be accommodated at our discretion but may extend the timeline; revisions requested after production has commenced may not be possible and do not entitle you to cancel under Section 8. Custom Orders are subject to the strict No Cancellation & No Refund Policy described in Section 8 and in our dedicated Cancellation, Return & Refund Policy, without exception for change of mind, delay in your own readiness to receive the piece, or a change in your requirements after production has commenced.
This is a fundamental term of your purchase and is repeated here for clarity, in addition to our full Cancellation, Return & Refund Policy, which forms part of these Terms:
We ship to customers worldwide, subject to our Shipping & Delivery Policy and, for Orders outside India, our International Shipping, Customs & Export Compliance Policy. You are responsible for ensuring that importing the ordered goods into your country is lawful, and for any import duties, taxes, or customs formalities applicable at the destination. Risk in the goods passes to you upon Dispatch to the courier/freight partner, except where our Cancellation, Return & Refund Policy expressly provides otherwise (transit loss/destruction).
All content on the Site — including text, graphics, logos, product photography, and design — is the property of [Business Legal Name] or its licensors and is protected under the Copyright Act, 1957 and applicable trademark law. You may not reproduce, distribute, or create derivative works from any part of the Site without our prior written consent. Purchasing a physical product grants you ownership of that physical item only; copyright and reproduction rights in the underlying artistic work remain with the artist/Company unless explicitly transferred to you in writing. Photographs of custom-commissioned pieces may be used by us in our portfolio, marketing, and social media unless you request otherwise in writing at the time of order.
If you register an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [support email] of any unauthorised use. We reserve the right to suspend or terminate an account at our discretion where we reasonably believe these Terms have been breached, without prejudice to any Order already confirmed. You agree not to: (a) use the Site for any unlawful purpose, including attempting to import restricted goods into your country; (b) attempt to gain unauthorised access to the Site or its related systems; (c) upload or transmit viruses or malicious code; (d) post false, misleading, or defamatory reviews or content; or (e) interfere with the proper functioning of the Site.
Where you submit a product review, photo, or testimonial, you grant us a non-exclusive, royalty-free, worldwide licence to display and use that content on the Site and in our marketing, and you confirm the content is your own and does not infringe any third party’s rights. We reserve the right to remove any review or content that is abusive, defamatory, unrelated to the product, or otherwise breaches these Terms.
Any discount code, coupon, or promotional offer is subject to its own stated terms (validity period, minimum order value, eligible products) and may be withdrawn or modified by us at any time before an Order is confirmed. Promotional value is non-refundable and non-transferable, and does not entitle you to any exception from Sections 4, 6, or 8 of these Terms.
Where the Site describes IT services offered by us, the specific scope of work, timelines, deliverables and fees for any such engagement will be governed by a separate written agreement or service order between you and us, in addition to these Terms.
Other than the express undertakings in our Cancellation, Return & Refund Policy and any statutory warranty that cannot lawfully be excluded, products are sold without further warranty as to fitness for a particular purpose, structural longevity beyond ordinary handling, or suitability for a specific installation environment (for example, outdoor exposure to weather for pieces intended for indoor display). Please review product descriptions and, for Custom Orders, confirm intended use with us before ordering.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products purchased through it, including without limitation loss of enjoyment, delay-related inconvenience, or customs seizure of an international shipment. Our aggregate liability in respect of any Order shall not exceed the amount actually paid by you for that specific Order. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2019 that cannot lawfully be excluded by contract.
We shall not be liable for any failure or delay in performance (including the 15-day minimum processing window, Custom Order timelines, or delivery estimates) caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, courier or customs disruptions, port congestion, pandemics, or government action. Performance obligations affected by a force majeure event are suspended for the duration of that event, and neither party may treat the delay as a breach entitling it to terminate the Order.
The Site may contain links to third-party websites or use third-party services (such as payment gateways, couriers, and analytics providers). We are not responsible for the content, policies, or practices of any third-party site or service.
You agree to indemnify and hold harmless [Business Legal Name], its owners, employees, and affiliates from any claim, loss, or demand, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site, or your failure to comply with your own country’s import laws.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, or sale of business assets.

No failure or delay by us in exercising any right under these Terms operates as a waiver of that right. If any provision of these Terms is held invalid or unenforceable by a competent court or consumer forum, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, and every Order placed through the Site regardless of the customer’s location, are governed exclusively by the laws of India. Subject to the consumer-forum jurisdiction provisions of the Consumer Protection Act, 2019 (available to Indian-resident consumers), any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan, India. International customers agree that any dispute will similarly be resolved under Indian law and, where litigation is not practicable across borders, the parties will first attempt resolution through our Grievance Redressal Policy.
In accordance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, grievances relating to the Site or an Order may be addressed to our Grievance Officer — see the Grievance Redressal Policy for contact details.
These Terms, together with the policies incorporated by reference in Section 1, constitute the entire agreement between you and us regarding your use of the Site and any Order, superseding any prior discussions, save for any written Custom Order specification separately agreed under Section 6. These Terms are drafted in English; any translation provided is for convenience only, and the English version prevails in the event of any inconsistency.
We may revise these Terms at any time by posting an updated version on this page. Continued use of the Site, or placing a new Order, after changes are posted constitutes your acceptance of the revised Terms. The Terms in force at the time you place a specific Order govern that Order.
